REGULATIONS OF THE LOYALTY PROGRAM VIP CARD HERON LIVE HOTEL

Valid from July 1, 2016

I. General Provisions.
1. The Terms and Conditions define the rules for joining the loyalty program 'Vip Card Heron Live Hotel'.
2. Organizer of the loyalty program Hotel Heron Sp. z o.o. Sp. z o.o. Sienna 104, 33-318 Gródek nad Dunajcem, KRS: 0000566768, NIP: 734-35-32-875, REGON: 361984560 II.

Participation in the Program.
1. The Participant of the Program may be only an adult natural person with full legal capacity,
2. The Participant of the Program may be a person using the services of Heron Live Hotel. A prerequisite is to leave contact details together with the email address and sign the consent form for the processing of personal data for marketing purposes.
3. Under the program, Cardholders will receive information about promotions, special offers and other important corporate events. The above information will be sent by e-mail (email), text messages or traditional mail.
4. In order to become a Silver Card holder, the total value of transactions completed in the last 12 calendar months at Heron Live Hotel must amount to a minimum of PLN 10,000 gross.
5. In order to become a Gold Card holder, the total value completed in the last 12 calendar months of transactions at Heron Live Hotel must amount to a minimum of PLN 20,000.
6. In order to become a Black Card holder, the total value completed in the last 12 calendar months of transactions at Heron Live Hotel must amount to a minimum of PLN 40,000.
7. The Card may also be granted discretionary, assigned by the General Manager, Reception Manager or Marketing Manager of Heron Live Hotel. This card is granted for 12 months. The validity of the card is automatically renewed upon any purchase of services or goods at Heron Live Hotel of any value.
8. The organizer of the program — Heron Live Hotel allows you to find the holder of a discount card by means of purchase. Purchase entitles you to enjoy all privileges dedicated to one of the three types of cards. The costs of purchasing cards are respectively: Silver Card — 7,500 PLN gross; Gold Card — PLN 15,000 gross; Black Card — PLN 30,000 gross
9. The sum of the transaction value is the sum of individual transactions, not including corporate and occasional events. Transactions accrue to the account after the services performed, and not during their execution (do not include prepayments).

III. Program Participation Card.
1. Each participant will receive a plastic participation card in person at the Heron Live Hotel or by mail.
2. The card shall bear a number assigned to a particular person and the name and surname of the holder in order to identify the holder in the hotel system.
3. The card remains the property of the hotel. The Participant is not entitled to dispose of or transfer the card to third parties.
4. The Organizer shall not assume any liability for damages caused by the loss, theft or damage of the card.
5. In the absence of notification to the Organizer about the loss or theft of the card, the Organizer shall not be liable for unauthorized use of the card by outsiders.
6. The card entitles you to discount services:
- Accommodation (rental of rooms and suites) by booking only through the Heron Live Hotel Reception - by phone or e-mail
- Services in Live Spa (face and body treatments, massages, hairdressing services, purchase of retail cosmetics) - Assortment in the Hangar Music Club (spirits, drinks, menu menu dishes)
- Catering services in restaurants: Marina, Sienna 104 and Sky Bar (purchase dishes, drinks and spirits from menu cards)
- Assortment in
Hotel Boutique HAK (clothes, gadgets with hotel logo, regional products)
7. The card entitles you to discount hotel services:
- Black Card entitles you to a discount of 20% * - Gold Card entitles you to a discount of 15% *

- Silver Card entitles you to a discount of 10% * *Price discounts do not accumulate with other discounts and special offers of the hotel.

Basic price - standard prices found in the current hotel price lists. Special offers are not considered a base price or stay packages and cannot be considered as the base price on which a discount is charged for holding a Program Card. On such special offers, no discount for holding any of the Program Cards is granted.
8. If the card is lost, it is possible to issue a duplicate by Heron Live Hotel. Issuing a duplicate costs 50 PLN. The cost of making a duplicate is covered by the card holder at the Heron Live Hotel reception.
9. The card is intended for individual hotel bookings up to 5 guests staying in up to 2 rooms at the same time at the Heron Live Hotel.
10. Discount in Live SPA applies to the card owner and 1 accompanying person during a one-time visit.
11. Discount in Restaurants and Club applies to the bill paid by the cardholder when booking up to a maximum of 10 people.

IV. The benefits of having a card.
Participants receive price discounts for accommodation, catering and other services and products sold and provided at Heron Live Hotel. In order to take advantage of the price discounts, you must inform that you are the holder of the Program Card and present the appropriate card:
1. At the reception desk during check-in and final settlement for the stay.
2. When ordering meals in hotel restaurants.
3. In the Hangar Music Club when placing the order.
4. At the reception of Live SPA when paying for the service.
5. In the hotel's Hook Boutique when paying for goods.

In addition, Cardholders have the opportunity to take advantage of:
Silver Card:
- priority when booking seats and services at Heron Live Hotel
- later check-out, until 14:00, after prior arrangement with the reception the availability of hotel seats
- free admission to the Hangar Music Club for selected events after prior reservation at the hotel reception, maximum for the cardholder + 9 accompanying persons entering the holding Gold Card holder: -

- later check-out, until 14:00, after prior arrangement with the reception of the availability of hotel seats
- free admission to the Hangar Music Club for selected events after prior booking at the hotel reception, maximum for the cardholder + 9 accompanying guests with the card holder - VIP inserts into the hotel room
- upgrade to a room of higher category within the availability of such rooms within the stay date 5 discounts. are provided on condition of payment by


card holder for services. Implemented vouchers are not subject to an additional discount.

V. Final provisions.
1. The Organizer reserves the right to change the provisions of the Regulations, which will not affect the rights already acquired by the Participants. 2. Joining the Program and using the Program Cards is tantamount to acceptance of these terms and conditions on the part of the cardholder.
3. Complaints related to participation in the program The Participant may submit in writing or electronically to the hotel reception to the e-mail address: marketing@heron-hotel.com. Dissipation will occur within 14 days of submission.

VI.
1. The Participant agrees to the processing of his/her personal data by Hotel Heron Sp. z o.o. Sp. K. for statistical and marketing purposes in connection with the implementation of the loyalty program. Personal data are protected under the Act of 29 August 1997 on the protection of personal data. The consent in question will be confirmed by the Participant with his own signature on the application form.
2. The Participant will be informed by post or e-mail about the currently conducted promotional campaigns at Heron Live Hotel, provided that he agrees to this at the time of filling in the application form.
3. The Participant undertakes to inform the Organizer about the change of his/her personal data. In the event of no notification of the change of personal data, the Organizer shall not be liable for any delay or inaction caused by the failure to update the data.
4. The Participant has the right to view his/her personal data provided in connection with the implementation of the loyalty program, to request a change or deletion. For this purpose, the Participant may contact the Marketing Department of Heron Live Hotel by phone: +48 18 888 85 10, e-mail address: marketing@heron-hotel.com or personally at the address of the Organizer's registered office.
5. Withdrawal of consent to the processing of entrusted data pursuant to the provisions of point 4 shall be considered as resignation by the Participant from the loyalty program and termination of rights indicated in § III.
